This website is operated by Elegant Lifestyle  ("we" or "us" or Elegant Lifestyle). The following terms and conditions (the "Agreement") govern all use of this website (the "Site") and the services available on or at the Site (taken together with the Site, the "Service"). The Service is offered subject to your (the "User") acceptance without modification of all of the terms and conditions contained here and all other operating rules, policies and procedures that may be published from time to time on the Site by Elegant Lifestyle – including, without limitation, Shipping, Returns Policy, Privacy Policy and others. Do not use this Site if you do not agree with this Agreement. You must take the time to read and understand these Terms before using Elegant Lifestyle services. By registering with Elegant Lifestyle, you accept that you are entering into a contract with us under these Terms. People who register for Elegant Lifestyle establish an "Account" and become "Users". Wholesale accounts are regarded as “business” not as a “consumer”. Visitors to Elegant Lifestyle who do not become Users, but who nevertheless use the Site and/or download the App, affirm that they are bound by these Terms each time they access Elegant Lifestyle. You should be aware that these Terms may change from time to time as mentioned in Clause 1 below.

The website provides access to a number of services that may be used in accordance with these terms. The Service includes, but is not limited to:

• The ability to upload digital designs or images to the website or to email digital images to us so that we can process them on your behalf;

• The ability to order products of images that have been transferred or uploaded to the website of Elegant Lifestyle.

These terms or User Agreement govern the relationship between you and us. This website (and the services provided through the website) can only be used if you agree to these terms. You may only use the website in accordance with these terms. Only persons aged sixteen years or over may agree to these terms and use the website or the services offered through the website.

You certify that the Content you provide on or through the Elegant Lifestyle Site is accurate and that the information you provide on or through the Elegant Lifestyle Sites is complete. You are solely responsible for maintaining the confidentiality and security of your account including username, password, and PIN. Elegant Lifestyle is not responsible for any losses arising out of the unauthorized use of your account. You agree that Elegant Lifestyle does not have any responsibility if you lose or share access to your device. Any agreement between you and the issuer of your credit card, debit card, or other form of payment will continue to govern your use of such payment method on the Elegant Lifestyle Sites. You agree that Elegant Lifestyle is not a party to any such agreement, nor is Elegant Lifestyle responsible for the content, accuracy, or unavailability of any method used for payment. Your account may be restricted or terminated for any reason, at our sole discretion. Except as otherwise provided by law, at any time without notice to you, we may (1) change, restrict access to, suspend, or discontinue the Elegant Lifestyle Site or any portion of the Elegant Lifestyle Site, and (2) charge, modify, or waive any fees required to use any services, functionality or other content available through the Elegant Lifestyle Site or any portion of the Elegant Lifestyle Site.

• In connection with the Elegant Lifestyle Site, you will not:

  • Make available any Content through or in connection with the Elegant Lifestyle Site that is or may be in violation of the content guidelines set forth in Section 3.C (Prohibited Content) below.

  • Make available through or in connection with the Elegant Lifestyle Site any virus, worm, Trojan horse, Easter egg, time bomb, spyware, or other computer code, file or program that is or is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software, or equipment.

  • Use the Elegant Lifestyle Site for any commercial purpose, or for any purpose that is fraudulent or otherwise tortious or unlawful.

  • Harvest or collect information about users of the Elegant Lifestyle Site.

  • Interfere with or disrupt the operation of the Elegant Lifestyle Site or the systems, servers, or networks used to make the Elegant Lifestyle Site available, including by hacking or defacing any portion of the Elegant Lifestyle Site; or violate any requirement, procedure or policy of such servers or networks.

  • Restrict or inhibit any other person from using the Elegant Lifestyle Site.

  • Frame or mirror any portion of the Elegant Lifestyle Site, or otherwise incorporate any portion of the Elegant Lifestyle Site into any product or service, unless you obtain Elegant Lifestyle’s express prior written consent to do so.

  • Systematically download and store any Materials.

  • Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or otherwise gather any Materials, or reproduce or circumvent the navigational structure or presentation of the Elegant Lifestyle Site, without Elegant Lifestyle’s express prior written consent.

  • Cause injury to any person or entity.

  • Violate any law, rule, or regulation, or these Terms of Use.

  • You will not use the Elegant Lifestyle Site or Elegant Lifestyle’s name, logo, or brand to (1) send any unsolicited or unauthorized Content, including advertising, promotional materials, email, junk mail, spam, or other form of solicitation; or (2) use any meta tags or other hidden text or metadata utilizing a Elegant Lifestyle trademark, logo, URL, or product name without Elegant Lifestyle’s written consent;

  • You will not attempt to do anything, or permit, encourage, assist, or allow any third party to do anything, prohibited in this Section, or attempt, permit, encourage, assist, or allow any other violation of these Terms of Use.
